Prevent monopolies in California Cannabis

Did you know that the governors cannabis trailer bill proposes to repeal B&P Code Section 26051?

This is important. Passed by the voters as part of Proposition 64, Section 26051 includes language to prevent:

  • creation or maintenance of monopolies
  • unreasonable restraints on competition
  • violations of environmental protection laws

On Thursday, May 4 three Senate Budget Sub Committees will meet in a Joint Hearing to discuss "Cannabis Regulatory Implementation." The agenda includes the proposed trailer bill language. Cal Growers will communicate our position and concerns. We will be highlighting the repeal of Section 26051 and urging lawmakers to oppose erasing these important provisions.

Please add your voice: oppose the trailer bill unless it includes language to protect our economy and our environment.

RE: CANNABIS TRAILER BILL: OPPOSE THE REPEAL OF B&P SECTION 26051

Dear Chairs Wieckowski, Pan and Roth,

The governors budget trailer bill proposes to repeal B&P Code Section 26051. Passed by the voters, Section 26051 includes language to prevent a number of negative impacts, including:

  • the creation or maintenance of monopolies
  • violations of environmental protection laws

Preventing monopolies and protecting the environment are core goals for the regulation of cannabis. Section 26051 or other similar provisions intended to achieve the same outcomes must be clarified and implemented. We strongly encourage you to oppose the repeal of this critical section.
